Terms of use

The Musée national des beaux-arts du Québec displays images of numerous works of art on its website, some of which are still subject to copyright. To respect these rights, the Musée asks users not to reproduce the images posted on its site for uses other than fair dealing as outlined in the Copyright Act (for purposes such as private study, research, or education). 

In such cases, the Musée asks users to indicate the title of the work, the name of the artist, and any collection or copyright that may be mentioned. 

It is forbidden to modify the images in any way that could impact the integrity of the work (e.g., cropping the image, adding new elements, changing the colours). 

Under no circumstances should the Musée be associated with a product, project, or company solely through the use of an image posted on its site. 

Reproduction of the images for any purpose other than fair dealing as defined in the Copyright Act is strictly prohibited without prior authorization from the Musée. Reproductions can be requested from the Musée through the 

In posting images of the works in its collection on its website, the Musée assumes no responsibility for any recourse or claim that a third party may make, particularly with respect to copyright violations involving the use of an image in a way that is not permitted by law. 

The Musée national des beaux-arts du Québec uses rights statements from the RightsStatements.org consortium, licences from the Creative Commons organization, and the latter’s Public Domain (or Public Domain in Canada) Mark. Content that is clearly identified with one of these copyright marks may be used in accordance with the conditions specific to the mark. When use requires prior written authorization (licence), the interested party must contact the Musée or the rights holder. 

For all authorized use of the content, the user must mention the name of the artist or creator (if known) and the source (“Musée national des beaux-arts du Québec”), preferably with the inventory number, the name of the artist, the title of the work, the year it was created, the dimensions, or the URL of the content.

Public domain 

The Musée national des beaux-arts du Québec authorizes the free use of all images of archives and objects that are considered to be in the public domain, have been digitized, and are accessible online. These images are offered free of charge, without restriction, according to the associated notices. 

An object is considered to be in the public domain when it is no longer protected by copyright. The images may be copied, shared, and modified unconditionally, even for commercial purposes. A high-resolution image of the object is available for download. However, compiling images to replicate a similar or competing service is prohibited.

Public domain in Canada 

This work has been identified as being free of known restrictions under the 

of Canada (RSC, 1985, c. C-42). 

You can copy, modify, distribute, and perform the work, even for commercial purposes, all without asking permission. 

The work may not be free of known copyright restrictions in all jurisdictions. Since the duration of copyright varies from one jurisdiction to another, a work free of copyright restrictions in Canada may still be protected in another jurisdiction. 

Some people may hold other rights to the work, such as a patent or trademark, while others may hold rights to the way the work is used, such as image rights or the right to privacy. 

In Canada, moral rights to a work have the same duration as copyright. In some jurisdictions, the author’s moral rights may continue in perpetuity, extending beyond the end of the copyright. These rights may include the right to be identified as the author and the right to object to any mutilation or outrageous treatment of the work. The MNBAQ does not provide any warranty for the work and assumes no responsibility for any use of the work.

The Musée is in no way responsible for the accuracy of any document, information, or other content once it has been altered or modified in any way, after downloading or otherwise. When an online purchase is made through the site, the Musée collects only the personal information required to process a current or future order. Credit card numbers and the personal information required for online payment are sent only to the external supplier responsible for processing online transactions, as outlined in the online purchasing policy . The Musée does not keep any credit card numbers provided as part of an online transaction through the website.  

The Musée invites users to interact with its social media. To make sure these platforms are used for their intended purpose, users are asked to follow some basic rules outlined in the Musée’s netiquette policy .  

There is no minimum age for accessing the Musée national des beaux-arts du Québec website. However, the Musée wishes to emphasize that some of the images shown, while artistic in nature, may be considered inappropriate for young children. Parents and guardians are responsible for exercising the supervision they deem necessary to ensure that the minors for whom they are responsible use the site in an acceptable manner.  

Users under 18 years of age must obtain permission from a parent or guardian before submitting personal information via the Musée national des beaux-arts du Québec website. Since the Musée cannot verify ages conclusively, users must conduct themselves in good faith.
